Details of newly elected MLAs of the Nagaland Assembly Elections 2013

Analysis of Criminal Financial and other background details of newly elected MLAs of the Nagaland Assembly Elections 2013
Summary and Highlights:

Nagaland Election Watch (NGEW) and YouthNet have analysed affidavits of all 59 newly elected MLAs of Nagaland 2013 Assembly Elections.(Elections in one constituency have been countermanded). Out of the 59 newly elected MLAs, 38 are from NPF, 8 are from INC, 4 are from NCP, 1 each from BJP and JD(U) and 7 are independent MLAs. (Election in one constituency has been countermanded)
Financial:
·         Crorepati MLAs: Out of these 59 MLAs, 36 (or 61%) are crorepatis. In 2008, there were 38% crorepati MLAs (23 out of 60 MLAs in 2008).
·         Average Assets: The average asset per MLA in the Nagaland 2013 Assembly Elections is Rs 3.18 Crore. In 2008 Nagaland Assembly Elections for the 60 MLAs analyzed, the average asset per MLA was Rs.3.8 Crore.
·         Party-wise Average Assets: Among major parties, the average asset per MLA for NPF is Rs 3.67 Crore and for INC is Rs 3.45 crores. In 2008, the average asset per MLA for NPF was Rs 3.70 crores and that for INC was Rs. 5.28 crores.
 ·        Highest Asset MLAs: The top three MLAs with highest declared assets are (in decreasing order):Neiphiu Rio of NPF from Northern Angami-II constituency with Rs. 30.07 crores worth of assets and Tokheho of INC from Dimapur-III constituency with assets worth Rs. 13.74 crores and Nuklutoshi of NPF from Arkakong constituency with assets worth Rs 13.29 crores.
 ·         Low Asset MLAs: A total of 8 MLAs out of 59 analyzed have declared assets less than Rs. 30 Lakh.
 ·         Lowest Asset MLAs: Imtikumzuk of INC from Aonglenden constituency has declared the lowest assets of Rs 12.76 lakhs followed by P. Paiwang Konyak of BJP from Tizit constituency has declared assets worth Rs 16.34 lakhs and B.S.Nganlang of JD(U) from Tamlu constituency with assets worth Rs20.20 lakhs.
 ·         Liabilities: Only 1 MLAs out of 59 analyzed have declared liabilities.
·         MLA with Liability: Only1 MLAhas declared the liabilities is S.I.Jamir an INC MLA from Dimapur-II constituency has declared liabilities of Rs. 1.65Crore. (This liability of Rs 1.65 crores has been put under the Disputed Liability category in the affidavit)
·         Chances of Winning: Among the candidates with assets of Rs. 5 crore and above 12 have got elected out of 22, which means that if a candidate has Rs. 5 crore and more the chances of his winning the election is 55%. But chances of winning drops to only 16% if a candidate has assets less than Rs. 25 Lakhs, as only 7 candidates out of 45 with assets less than Rs. 25 lakhs have managed to win their elections.
·         Lakhpati candidates win over Crorepati candidates: Despite, the overwhelming number of crorepati MLAs in the Nagaland Assembly. In 15 constituencies, Lakhpati candidates emerged as winners, defeating higher asset crorepati candidates in their respective constituencies.
 ·         Undeclared PAN: 24 out of all 59 (41%) MLAs in the Nagaland 2013 Assembly Elections have not declared their PAN details. In 2008 58 (97% of the 60 MLAs analyzed) had not declared their PAN details
 ·         Undeclared PAN Party-wise: 13 out of 25 MLAs of NPF have not declared their PAN. Similarly, for INC 4 out of 8 MLAs have not declared PAN details.

Criminal
·         Out of the 59 MLAs analyzed, 1 MLA (or 2 %) has declared criminal cases against them. In 2008 assembly elections, none of the MLAs had declared criminal cases against themselves.
·         MLA with criminal charges and also charges framed: Only 1 MLA has declared criminal cases against himself. He is Neiba Kronu of NPF from Pfutsero constituency with declared charge of Prevention of Corruption Act and 1 charge under criminal conspiracy. He has also declared that charges have been framed against him.
Other Background details (Education, Gender, Age):
 ·         MLAs’ Education:A total of 42 (71%) MLAs (out of 59 analyzed) are graduates or have higher degrees in the Nagaland 2013 Assembly Elections.
 ·         MLAs’ Age:A total of 15 MLAs, out of all the 59 that have been analyzed, are 60 or more years of age. 6 MLAs are aged 40 years or less.
 ·         Women MLAs:Out of 59 MLAs, there is not even a single woman MLA in  the Nagaland 2013 Assembly Elections (as similar to Nagaland assembly elections 2008).
 Summary of asset comparison of re-elected MLAs
·         MLAs  contested  Again:27  re-elected (MLAs who fought elections in 2008 and now in 2013 are again in the fray) MLAs have been analyzed for the Nagaland Assembly Elections 2013
·         Average Assets in 2008 Elections: The average assets of these 27 re-elected MLAs fielded by various parties in 2008 was Rs 4,53,02,585(4.53Crores)
·         Average Assets in 2013 Elections: The average assets of these 27 re-elected MLAs now in 2013 is Rs 4,78,83,953(4.78Crores)
·         Average Asset growth in 5 years(2008-2013):The average asset growth forthese 27 re-elected MLAs,between the Nagaland Assembly Elections of 2008 and 2013, is Rs25,81,368 (25.81 Lakhs)
·         Percentage growth in 5 years (2008-2013):Average percentage growth in assets for these 27 re-elected MLAs is 6%
·         Highest growth In Assets in 5 years (2008-2013):Neiphiu Rio (of NPF from Northern Angami-II) have increased by Rs 23.83 crore, from Rs 6.23 crore in 2008 to Rs 30.07  crore in 2013(In 2008, Neiphiu Rio didn’t provide the information related to the value of Deposits in 5 Bank Accounts and 3 Insurance Policies). Tokheho (of INC from Dimapur-III) have risen by Rs 11.49 crore, from Rs 2.25 crore in 2008 to Rs 13.74 crore in 2013(In 2008, Tokheho didn’t provide the information related to the value of 4 Insurance Policies and 2 Motor vehicle). Assets of Neiba Kronu (of NPF MLA from Pfutsero) have increased by Rs 7.02 crore, from Rs2.83 crore in 2008 to Rs 9.85  crore in 2013(In 2008, K. Konngam Konyak didn’t provide the information related to the value of a Motor Vehicle).
·         Highest Percentage growth in 5 years (2008-2013): The highest percentage increase (4505%) in assets has been declared by Torechu an NPF MLA from Pungro-Kiphire constituency. Torechu assets increased fromRs. 2.6 lakhs in 2008 to Rs 1.19 crore in 2013 (In 2008, Torechu didn’t provide the information related to the value 3 Vehicles). Chotisuh Sazo of NPF MLA from Chazouba constituency falls second position with 3672% increase in assets; his assets have grown from Rs 2.32 lakhs in 2008 to Rs 87.51 Lakhs in 2013 (In 2008, Chotisuh Sazo didn’t provide the information related to the value of a Motor Vehicle and a Residential Building) and S. Pangnyu also from NPF MLA from Longleng constituency falls at third position with 1931% increase in assets: from Rs.8.33 Lakhs in 2008 to Rs.1.69 crore in 2013.
Asset decrease in 5 years (2008-2013): 3 MLAs have reported decrease in assets in 2013 as compared to value of assets in 2008. Among them the highest decrease has been shown by S.I.Jamir (89% decline in assets, Rs 35.33Crores in 2008 to Rs 3.87Crores in 2013) of INC from Diampur-II constituency(In 2008, S.I. Jamir didn’t provide the information related to the value of a Motor Vehicle), Kiyanilie Peseyie (81% reduction in assets, from Rs 9.04Crores in 2008 election to Rs1.72Crores in 2013) of NPF from Western Angami, and Nuklutoshi (68%) decline in assets, Rs 40.97Crores in 2008 to Rs 13.29 Crores in 2013) of NPF from Arkakong constituency.

Details of newly elected MLAs of the Tripura  Assembly Elections 2013
Summary and Highlights: Tripura Election Watch (TEW) has analysed affidavits of all 60 newly elected MLAs of Tripura 2013 Assembly Elections. Out of the 60 newly elected MLAs, 49 are from CPI(M), 10 are from INC and 1 is from CPI.
Financial: ·         Crorepati MLAs: Out of these 60 MLAs, 8 (or 13%) are crorepatis. In 2008, there were 5% crorepati MLAs (3 out of 60 MLAs in 2008).
·         Average Assets: The Average Asset per MLA in Tripura Assembly Elections 2013 is Rs. 53.61 lakhs. In 2008 Tripura Assembly Elections for the 60 MLAs analysed the average asset per MLA was Rs. 29.98 Lakhs.
·         Party-wise Average Assets: Among major parties, the average asset per MLA for CPI(M) is Rs. 27.59 lakhs and for INC is Rs. 1.83 crores. In 2008 the average asset per MLA for CPI(M) was Rs. 14.86 Lakhs and for INC it was Rs. 1.052 crores.
 ·         Highest Asset MLAs: The top three MLAs with highest declared assets are (in decreasing order): Dilip Sarkar of INC from Badarghat (SC) constituency with Rs. 4.58 crores worth of assets and Pranajit Singha Roy of INC from Radhakishorpur constituency with assets worth Rs. 4.03 crores and Biswabandhu Sen of INC from Dharmanagar constituency with assets worth Rs 2.25 crores. From CPI (M) the MLA with highest assets is Jitendra Choudhari from Manu (ST) constituency with assets of Rs 1.55 crores. (Please find later in the report the list of top 20 MLAs with highest declared assets who are  the Tripura 2013 Assembly Elections)
·         Low Asset MLAs: A total of 11 MLAs out of 60 analysed have declared assets less than Rs. 10 Lakh.
 ·         Lowest Asset MLAs: Diba Chandra Hrangkhawl of INC from Karamchara constituency has declared the lowest assets of Rs 6 thousand followed by Niranjoy Tripura of CPI(M) from Chawmanu (ST) constituency has declared assets worth Rs 88 thousand and Priyamani Debbarma of CPI(M) from Karbook (ST) constituency with assets worth Rs 1.10 lakhs.

·         Liabilities: A total of 9 MLAs out of 60 analyzed have declared liabilities of Rs. 10 lakhs or above.
·         Highest Liability MLAs: The top three MLAs with highest declared liabilities are(in decreasing order): JitendraChaudhuri  a CPI(M) MLA from Manu (ST) constituency has declared the highest liabilities of Rs. 28.24 lakhs followed by Rajendra Reang of CPI(M) from Kanchanpur (ST) constituency with assets of Rs 20.96 lakhs and Bijoy Lakshmi Singha of CPI(M) from Kamalpur constituency with assets worth Rs 15.03 lakhs. From INC the MLA with highest liabilities is Birajit Sinha from Kailshahar constituency with liabilities worth Rs 14.56 lakhs.
·         Undeclared PAN: 29 out of all 60 (48%) MLAs in the Tripura 2013 Assembly Elections have not declared their PAN details. In 2008, 51 MLAs (85% of 60 analyzed) had not declared their PAN details.
·         Undeclared PAN Party-wise: 27 out of 49 MLAs of CPI(M) have not declared their PAN. Similarly, for INC 2 out of 10 MLAs have not declared PAN details.
·         MLAs who declared Income: 9 MLAs have declared an income in their ITR. (Almost all other MLAs have claimed to be exempted from paying Income Tax under Section 10(26) of the Income Tax Act).
·         Highest Income MLAs: Out of the 9 MLAs who have declared an income, the top three MLAs with the highest income are as follows: Pranajit Singha Roy of INC from Radhakishorpur constituency with total income worth Rs  30.38Lacs. He is followed by Birajit Sinha of INC from Kailashahar constituency with total income of Rs 7.69 lakhs and Ratan lal Nath of INC from Mohanpur constituency with total income worth Rs 7.66 lakhs. From CPI(M) the MLA with declared highest income is Bijita Nath from Bagbassa constituencies with income of Rs 2.63 lakhs.
·         Chances of Winning based on Assets: Among the candidates with assets of Rs. 1 crore and above 8 have got elected out of 16, which means that if a candidate has Rs. 1 crore and more the chances of his winning the election is 50%. But chances of winning drops to only 6% if a candidate has assets less than Rs. 5 Lakhs, as only 7 candidates out of 108 with assets less than Rs. 5 lakhs have managed to win their elections.
·         Lakhpati candidates win over Crorepati candidates: In 7 constituencies, Lakhpati candidates emerged as winners, defeating higher asset Crorepati candidates in their respective constituencies.
Criminal:

·         MLAs with declared criminal cases: Out of 60 MLAs, 6 MLAs (or 10 %) have declared criminal cases against themselves. All the 6 MLAs with declared criminal cases are from INC. In 2008 assembly elections, 5% of the MLAs (3 out of 60 MLAs) had declared criminal cases against themselves.
·         MLAs with Serious Criminal Cases: Out of the total 6 MLAs who have declared criminal cases,5 have declared serious criminal cases like murder, attempt to murder.
·         MLAs against whom charges have been framed: Out of these 6 MLAs with self-declared criminal cases, charges have been framed against 4 MLAsin various cases. These are Ratan Lal Nath (INC), Gopal Chandra Roy (INC), Birajit Sinha(INC), and Biswabandhu Sen (INC).
·         MLAs with Heinous & Violent Crime Cases:The top three MLAs from major parties who have declared maximum number of serious criminal cases of murder, attempt to murder etc against them are:(1)Birajit Sinha (of INC from Kailashahar constituency) has declared one charge related to murder.(2). Ratan lal Nath(of INC from Mohanpur constituency) has declared 1charge related to attempt to murder (3) Gopal Chandra Roy of INC from Banamalipur constituency has declared one charge related to attempt to murder.
 Other Background details (Education, Gender, Age):

 ·         MLAs’ Education: A total of 28 (47%) MLAs (out of 60 analyzed) are graduates or have  higher degrees in the Tripura 2013 Assembly Elections. 20 MLAs (33%)are 10th Pass or below.
 ·         MLAs’ Age: A total of 3 MLAs, out of all the 60, are of 70 years and above. 1 MLA is aged 40 or less
 ·         Women MLAs: Out of 60 MLAs, 5 (8%) women are the Tripura 2013 Assembly Elections. In 2008 there were 3 women MLAs (5% of the 60 analyzed).

Asset Comparison of Re-elected MLAs:
·         MLAs  elected  Again: 43  MLAs have been re-elected  from the 2008 Tripura Assembly to the Tripura Assembly 2012.
·         Average Assets in 2008 Elections: The average assets of these 43 re-elected MLAs fielded by various parties in 2008 was Rs 25,15,729(25.15 Lakhs).
·         Average Assets in 2013 Elections: The average assets of these 43 re-elected MLAs now in 2013 is Rs 48,93,386(48.93 Lakhs).
·         Average Asset growth in 5 years(2008-2013):The average asset growth for these 43  re-elected MLAs, between the Tripura Assembly Elections of 2008 and 2013, is Rs 23,77,656 (23.77 Lakhs).
·         Percentage growth in 5 years (2008-2013):Average percentage growth in assets for these 43 re-elected MLAs is 95%
·         Highest growth In Assets in 5 years (2008-2013): Dilip Sarkar (of INC from Badharghat) have increased by Rs 2.03 crore, from Rs 2.54 crore in 2008 to Rs 4.58 crore in 2013. Sudip Roy Barman (of INC from Agartala) have risen by Rs 1.38 crore, from Rs 69.39 Lakhs in 2008 to Rs 2.07 crore in 2013 (In 2008, Sudip Roy Burman didn’t provide the information related to the value of 1 Motor vehicle). Assets of Gopal Chandra Roy (also a INC MLA from Banamalipur) have increased by Rs 92.40 Lakhs, from Rs 54.22 Lakhs in 2008 to Rs 1.46 crore in 2013.
·         Highest Percentage growth in 5 years (2008-2013): The highest percentage increase (8988%) in assets has been declared by Subodh Das of CPI (M) from Panisagar constituency. Subodh Das’s assets increased from Rs. 3 Thousands* in 2008 to Rs 3.14* Lakhs in 2013. Keshab Debbarma of CPI (M) from Golaghati (SC) constituency falls at second position with 5945% increase in assets; his assets have grown from Rs 61* Thousands in 2008 to Rs 37.35* Lakhs in 2013. Aghore Debbarma of CPI (M) from Khowai constituency falls at third position with 5397% increase in assets; his assets have grown from Rs 66* Thousands in 2008 to Rs 36.51* Lakhs in 2013. (* this figure contains only that sum of money that has been explicitly provided in the affidavits, this figure doesn’t include the value of assets for which value wasn’t provided in the affidavits)

Among them the highest decrease has been shown by Padma Kumar Debbarma (83% decline in assets, Rs 9.11 Lakhs in 2008 to Rs 1.58 lakhs in 2013) of CPI(M) from Ramchandraghat (ST) constituency, Mano Ranjan Acharjee (71% reduction in assets, from Rs 5.33 lakhs in 2008 election to Rs 1.54 lakhs in 2013) of CPI(M) from Amarpur, and Basudev Majumder (40% decline in assets, Rs 22.20 Lakhs in 2008 to Rs 13.31 lakhs in 2013) of CPI(M) from Belonia constituency.
