Analysis of Financial, Criminal and Other details of newly elected MLAs in the  Meghalaya Assembly Elections, 2013

Summary and Highlights:

·         Meghalaya Election Watch (MGEW) has analyzed affidavits of all 60 newly elected MLAs in the Meghalaya 2013 Assembly Elections.  Out of the 60 newly elected MLAs, 29 are from INC, 8 are from UDP, 4 are from HSPD, 2 are from NPP, 2 are from NCP, 1 is from NESDP, 1 from GNC and 13 are Independent MLAs.  
Financial:
·         Crorepati MLAs: Out of these 60 MLAs, 36 (or 60%) are crorepatis. In the 2008 assembly elections, 15 out of 60 MLAs analyzed (or 25%) were crorepatis.
·         Average Assets: The average asset per MLA in the Meghalaya 2013 Assembly Elections is Rs 7.77 Crore. In 2008 Meghalaya Assembly Elections for the 60 MLAs analyzed, the average asset per MLA was Rs 1.12 Crore.
·         Party-wise Average Assets: Among major parties, the average asset per MLA for INC (29 MLAs) is Rs 12.35 Crore, for UDP (8 MLAs) is Rs 6.73 Crore, for NPP (2 MLAs) is Rs 3.52 Crore, for HSPD (4 MLAs) is Rs 52.65 Lakhs, for NCP (2 MLAs) is Rs 3.26 Crores, for NESDP (1 MLA) is Rs 13.01 Crore and for GNC (1 MLA) is Rs 42.12 Lakhs. The average asset per Independent MLA (13 MLAs) is Rs. 1.94 crore. In 2008, the average asset per MLA for INC (25 MLAs) was Rs. 98 Lakhs, for UDP (11 MLAs) was Rs. 2.59 Crores and for NCP (15 MLAs) was 68 Lakhs.
·         Highest Asset MLAs: The top three MLAs with highest declared assets are (in decreasing order): Ngaitlang Dhar of INC from Umroi (ST) constituency who has declared assets worth Rs. 235.64 crores, followed by Metbah Lyngdoh of UDP from Mairang (ST) constituency with Rs. 37.29 crores worth of assets and Comingone Ymbon of INC from Raliang (ST) constituency with assets worth Rs. 25.48 crores. (Please find later in the report the list of top 20 newly elected MLAs with highest declared assets from the Meghalaya 2013 Assembly Elections)
·         Low Asset MLAs: Only 5 MLAs have declared assets less than Rs. 25 Lakhs.

·         Lowest Asset MLAs: Michael T Sangma an Independent MLA from Tikrikilla(ST) constituency has declared that he has assets worth only Rs.6.47 Lakhs, followed by Embhahlang Syiemlieh of UDP from Mawlai(ST) constituency with assets worth only Rs. 9.86 Lakhs and Kenethson R Sangma of INC from Dalu(ST) constituency with assets worth Rs. 17.67 Lakhs.
·         Liabilities: A total of 12 MLAs out of 60 analyzed have declared liabilities of Rs. 10 lakhs or above.
·         Highest Liability MLAs: The top three MLAs with highest declared liabilities are (in decreasing order): Metbah Lyngdoh, a UDP MLA from Mairang (ST) constituency who has declared the highest liabilities worth Rs. 11.11 Crores followed by Ngaitlang Dhar of INC from Umroi(ST) constituency with liabilities of Rs. 9.89 Crores and Sniawbhalang Dhar  an INC MLA from Nartiang(ST) constituency with liabilities of Rs. 1.29 Crores.
·         Undeclared PAN: 10 out of 60 (17%) MLAs from the Meghalaya 2013 Assembly Elections have not declared their PAN details.

·         Undeclared PAN Party-wise: 6 out of 29 MLAs of INC have not declared their PAN. Similarly, 1 out of 8 for UDP, 1 out of 4 of HSPD, 1 out of 1 of GNC and 1 Independent MLA out of 13 have not declared PAN details.

·         MLAs who declared Income: 1 MLA declared an annual income in their ITR namely Abu Taher Mondal of INC from Phulbari constituency. (Almost all other MLAs have claimed to be exempted from paying Income Tax under Section 10(26) of the Income Tax Act).

·         Chances of Winning based on assets: Among the candidates with assets of Rs. 5 crore and above 13 have got elected out of 30 who contested, which means that if a candidate has Rs. 5 crore and more the chances of his winning the election is 43%. But chances of winning drops to only 4% if a candidate has assets less than Rs. 25 Lakhs, as only 5 candidates out of 116 with assets less than Rs. 25 lakhs have managed to win their elections.

·         Lakhpati candidates win over Crorepati candidates: Despite, the overwhelming number of crorepati MLAs in the Meghalaya Assembly. In 16 constituencies, Lakhpati candidates have emerged as winners, defeating higher asset crorepati candidates in their respective constituencies.

Criminal:

·         MLAs with Criminal Cases: Out of the 60 MLAs, 1 MLA (or 2%) has declared a criminal case against himself. In 2008 assembly elections, 2% of MLAs (1 out of the 60 MLAs) declared criminal cases against themselves.
·          Party wise MLAs with Criminal Cases: 1 MLA of INC namely Ngaitlang Dhar from Umroi(ST) constituency has declared criminal cases against himself.

Other Background details (Education, Gender, Age):
·         MLAs’ Education: A total of 36 (60%) MLAs are graduates or have higher educational qualifications in the Meghalaya 2013 Assembly. 11 MLAs (18%) are 10th Pass or below.
 ·         MLAs’ Age: A total of 4 MLAs, are aged 70 or more. 15 MLAs are aged 40 or less.
 ·         Women MLAs: Out of all 60 MLAs, 4 (7%) are women in the Meghalaya 2013 Assembly . All 4 women MLAs are from the INC.  In Meghalaya 2008 Assembly, there was only 1 woman MLA.
Asset Comparison of Re elected MLAs:

·         MLAs who have been re elected again23 MLAs have been re elected again from the 2008 Meghalaya Assembly to the Meghalaya Assembly, 2013.
·         Average Assets in 2008 Elections: The average assets of these 23 re-elected MLAs as declared in the Meghalaya 2008 Assembly Elections was Rs 1,51,03,966 (1.51 Crore).
·         Average Assets in 2013 Elections: The average assets of these 23 re-elected MLAs now in 2013 is Rs 5,28,00,836 (5.28 Crore).
·         Average Asset growth in 5 years (2008-2013): The average asset growth for these 23  re-elected MLAs, between the Meghalaya Assembly Elections of 2008 and 2013, is Rs 3,76,96,869   (3.76 Crore).
·         Percentage growth in 5 years (2008-2013): Average percentage growth in assets for these 23 re-elected MLAs is 250%.
·         Highest growth In Assets in 5 years (2008-2013): Comingone Ymbon of INC from Raliang (ST) constituency has declared maximum increase in assets with an increase of Rs 24.26 crore i.e from Rs 1.21 crores in 2008 to Rs. 25.48 crores in 2013 (In 2008, Comingone Ymbon (a) didn’t provide information related to the value of 2 Motor Vehicles and gold possessed by his wife. Also, Rs. 1.21 crore in 2008 elections does not include values of 18 insurance policies of worth 59 Lakhs). Assets of Metbah Lyngdoh (of UDP from Mairang (ST) constituency) have increased by Rs 16.29 crore, from Rs 21 crore in 2008 to Rs 37.29 crore in 2013*. Assets of Dr.Mukul Sangma (of INC from Ampati (ST) constituency have risen by Rs 11.07 crore, from Rs 3.43 crore in 2008 to Rs 14.50 crore in 2013(In 2008, Mukul Sangma (a) didn’t provide information related to the value of 7 Motor Vehicles, 5 pieces of non agricultural land (b)this does not include values of 8 insurance policies of worth 47 Lakhs). (* this figure contains only that sum of money that has been explicitly provided in the affidavits, this figure doesn’t include the value of assets for which value wasn’t provided in the affidavits)
Highest Percentage growth in 5 years (2008-2013): The highest percentage increase (39439%) in assets has been declared by Sniawbhalang Dhar of INC from Nartiang (ST) constituency. His assets increased from Rs. 75,074 in 2008 to Rs 2.96 Crore in 2013 (In 2008, Sniawbhalang Dhar didn’t provide information related to the value of 3 Motor Vehicles,25 tolas gold possessed by his wife,1 Building and another plot of land). Mazel Ampareen Lyngdoh of INC from East Shillong(ST) constituency has declared an increase of 9196% in her assets, her assets have risen from Rs. 23,518 in 2008 to Rs 21.86 Lakhs in 2013(This does not include value of Motor Vehicles). Nihim D Shira of NPP from Songsak (ST) constituency falls in third position with 3535% increase in assets; his assets have grown from Rs 2.72 Lakhs in 2008 to Rs 99.17 Lakhs* in 2013 (In 2008, Nihim D Shira (a) didn’t provide information related to the value of 1 Motor Vehicle (b) this does not include value of 2 insurance policies worth Rs 1 lakh).
