Analysis of Criminal Financial and other background details of newly elected MLAs of the Nagaland Assembly Elections 2013

Summary and Highlights:

Nagaland Election Watch (NGEW) and YouthNet have analysed affidavits of all 59 newly elected MLAs of Nagaland 2013 Assembly Elections.(Elections in one constituency have been countermanded). Out of the 59 newly elected MLAs, 38 are from NPF, 8 are from INC, 4 are from NCP, 1 each from BJP and JD(U) and 7 are independent MLAs. (Election in one constituency has been countermanded)
Financial:
·         Crorepati MLAs: Out of these 59 MLAs, 36 (or 61%) are crorepatis. In 2008, there were 38% crorepati MLAs (23 out of 60 MLAs in 2008).
·         Average Assets: The average asset per MLA in the Nagaland 2013 Assembly Elections is Rs 3.18 Crore. In 2008 Nagaland Assembly Elections for the 60 MLAs analyzed, the average asset per MLA was Rs.3.8 Crore.
·         Party-wise Average Assets: Among major parties, the average asset per MLA for NPF is Rs 3.67 Crore and for INC is Rs 3.45 crores. In 2008, the average asset per MLA for NPF was Rs 3.70 crores and that for INC was Rs. 5.28 crores.
 ·        Highest Asset MLAs: The top three MLAs with highest declared assets are (in decreasing order):Neiphiu Rio of NPF from Northern Angami-II constituency with Rs. 30.07 crores worth of assets and Tokheho of INC from Dimapur-III constituency with assets worth Rs. 13.74 crores and Nuklutoshi of NPF from Arkakong constituency with assets worth Rs 13.29 crores.
 ·         Low Asset MLAs: A total of 8 MLAs out of 59 analyzed have declared assets less than Rs. 30 Lakh.
 ·         Lowest Asset MLAs: Imtikumzuk of INC from Aonglenden constituency has declared the lowest assets of Rs 12.76 lakhs followed by P. Paiwang Konyak of BJP from Tizit constituency has declared assets worth Rs 16.34 lakhs and B.S.Nganlang of JD(U) from Tamlu constituency with assets worth Rs20.20 lakhs.
 ·         Liabilities: Only 1 MLAs out of 59 analyzed have declared liabilities.
·         MLA with Liability: Only1 MLAhas declared the liabilities is S.I.Jamir an INC MLA from Dimapur-II constituency has declared liabilities of Rs. 1.65Crore. (This liability of Rs 1.65 crores has been put under the Disputed Liability category in the affidavit)
 ·         Chances of Winning: Among the candidates with assets of Rs. 5 crore and above 12 have got elected out of 22, which means that if a candidate has Rs. 5 crore and more the chances of his winning the election is 55%. But chances of winning drops to only 16% if a candidate has assets less than Rs. 25 Lakhs, as only 7 candidates out of 45 with assets less than Rs. 25 lakhs have managed to win their elections.
·         Lakhpati candidates win over Crorepati candidates: Despite, the overwhelming number of crorepati MLAs in the Nagaland Assembly. In 15 constituencies, Lakhpati candidates emerged as winners, defeating higher asset crorepati candidates in their respective constituencies.
 ·         Undeclared PAN: 24 out of all 59 (41%) MLAs in the Nagaland 2013 Assembly Elections have not declared their PAN details. In 2008 58 (97% of the 60 MLAs analyzed) had not declared their PAN details
 ·         Undeclared PAN Party-wise: 13 out of 25 MLAs of NPF have not declared their PAN. Similarly, for INC 4 out of 8 MLAs have not declared PAN details.

Criminal
·         Out of the 59 MLAs analyzed, 1 MLA (or 2 %) has declared criminal cases against them. In 2008 assembly elections, none of the MLAs had declared criminal cases against themselves.
·         MLA with criminal charges and also charges framed: Only 1 MLA has declared criminal cases against himself. He is Neiba Kronu of NPF from Pfutsero constituency with declared charge of Prevention of Corruption Act and 1 charge under criminal conspiracy. He has also declared that charges have been framed against him.
Other Background details (Education, Gender, Age):
 ·         MLAs’ Education:A total of 42 (71%) MLAs (out of 59 analyzed) are graduates or have higher degrees in the Nagaland 2013 Assembly Elections.
 ·         MLAs’ Age:A total of 15 MLAs, out of all the 59 that have been analyzed, are 60 or more years of age. 6 MLAs are aged 40 years or less.
 ·         Women MLAs:Out of 59 MLAs, there is not even a single woman MLA in  the Nagaland 2013 Assembly Elections (as similar to Nagaland assembly elections 2008).
 Summary of asset comparison of re-elected MLAs
·         MLAs  contested  Again:27  re-elected (MLAs who fought elections in 2008 and now in 2013 are again in the fray) MLAs have been analyzed for the Nagaland Assembly Elections 2013
·         Average Assets in 2008 Elections: The average assets of these 27 re-elected MLAs fielded by various parties in 2008 was Rs 4,53,02,585(4.53Crores)
·         Average Assets in 2013 Elections: The average assets of these 27 re-elected MLAs now in 2013 is Rs 4,78,83,953(4.78Crores)
·         Average Asset growth in 5 years(2008-2013):The average asset growth forthese 27 re-elected MLAs,between the Nagaland Assembly Elections of 2008 and 2013, is Rs25,81,368 (25.81 Lakhs)
·         Percentage growth in 5 years (2008-2013):Average percentage growth in assets for these 27 re-elected MLAs is 6%
·         Highest growth In Assets in 5 years (2008-2013):Neiphiu Rio (of NPF from Northern Angami-II) have increased by Rs 23.83 crore, from Rs 6.23 crore in 2008 to Rs 30.07  crore in 2013(In 2008, Neiphiu Rio didn’t provide the information related to the value of Deposits in 5 Bank Accounts and 3 Insurance Policies). Tokheho (of INC from Dimapur-III) have risen by Rs 11.49 crore, from Rs 2.25 crore in 2008 to Rs 13.74 crore in 2013(In 2008, Tokheho didn’t provide the information related to the value of 4 Insurance Policies and 2 Motor vehicle). Assets of Neiba Kronu (of NPF MLA from Pfutsero) have increased by Rs 7.02 crore, from Rs2.83 crore in 2008 to Rs 9.85  crore in 2013(In 2008, K. Konngam Konyak didn’t provide the information related to the value of a Motor Vehicle).
·         Highest Percentage growth in 5 years (2008-2013): The highest percentage increase (4505%) in assets has been declared by Torechu an NPF MLA from Pungro-Kiphire constituency. Torechu assets increased fromRs. 2.6 lakhs in 2008 to Rs 1.19 crore in 2013 (In 2008, Torechu didn’t provide the information related to the value 3 Vehicles). Chotisuh Sazo of NPF MLA from Chazouba constituency falls second position with 3672% increase in assets; his assets have grown from Rs 2.32 lakhs in 2008 to Rs 87.51 Lakhs in 2013 (In 2008, Chotisuh Sazo didn’t provide the information related to the value of a Motor Vehicle and a Residential Building) and S. Pangnyu also from NPF MLA from Longleng constituency falls at third position with 1931% increase in assets: from Rs.8.33 Lakhs in 2008 to Rs.1.69 crore in 2013.
Asset decrease in 5 years (2008-2013): 3 MLAs have reported decrease in assets in 2013 as compared to value of assets in 2008. Among them the highest decrease has been shown by S.I.Jamir (89% decline in assets, Rs 35.33Crores in 2008 to Rs 3.87Crores in 2013) of INC from Diampur-II constituency(In 2008, S.I. Jamir didn’t provide the information related to the value of a Motor Vehicle), Kiyanilie Peseyie (81% reduction in assets, from Rs 9.04Crores in 2008 election to Rs1.72Crores in 2013) of NPF from Western Angami, and Nuklutoshi (68%) decline in assets, Rs 40.97Crores in 2008 to Rs 13.29 Crores in 2013) of NPF from Arkakong constituency.
